PLEASE READ THE ENTIRE AGREEMENT. THIS IS A LEGAL AGREEMENT BETWEEN YOU AND RAW ELEMENTS, LLC. 

BY SUBMITTING THE ONLINE APPLICATION YOU ARE AGREEING THAT YOU HAVE READ AND UNDERSTAND THE TERMS AND CONDITIONS OF THIS AGREEMENT AND THAT YOU AGREE TO BE LEGALLY RESPONSIBLE FOR EACH AND EVERY TERM
AND CONDITION. 

1. Overview
This Agreement contains the complete terms and conditions that apply to you becoming an “Affiliate” in RAW ELEMENTS’ “Affiliate
Program”. The purpose of this Agreement is to (1) allow a link between your website and the RAW ELEMENTS web site that tracks sales generated by the link and/or (2) allow a unique coupon code that tracks sales generated by the code. Please note that throughout this Agreement, "we," "us," and "our" refer to RAW ELEMENTS, and "you," "your," and "yours" refer to the affiliate. 

2. Rules

2.1 Gaming the system will lead to exclusion from the program and any commissions earned will be revoked. This pertains to, but not exclusively, mass distribution of the referral link and/or code in any form as well as referring yourself. 

2.2 You cannot refer existing Raw Elements customers.

2.3 Raw Elements may discontinue the Affiliate Program at any time and will not be liable for any loss of income.

2.4 You are not permitted, under any circumstances, to represent that you are acting on behalf of Raw Elements or
that you have the authority to enter in any agreement on behalf of Raw Elements.

2.5 The purchase must either be made through your unique referral link or involve your unique referral discount code in
order for you to be credited. You will not earn your commission if the referred customer fails to do so, and Raw Elements is under no obligation to pay you a commission in such case.

2.6 You acknowledge and agree that Raw Elements' determination will be final and binding with respect to the referring party's
eligibility for any Affiliate commission.

2.7 Raw Elements reserves the right, in its sole and absolute discretion, to exclude any participant at any time from the
program

2.8 Raw Elements reserves the right, in its sole and absolute discretion, to deny any application to the program.

2.9 The referring party shall govern himself/herself in a legal and ethical manner. The referring party shall not
misrepresent Raw Elements' products and prices or impose any fees or charges or minimums in connection with Raw Elements’ products.

2.10 Raw Elements reserves the right to investigate any suspicious or inappropriate registration or activity. Raw
Elements, in its sole discretion, reserves the right to delay payment of any Affiliate commission while it conducts an investigation of any such activity. If Raw Elements, in its sole discretion, concludes a registration was deceptive, you agree that Raw Elements will not be obligated to pay any Affiliate commission for such registration. 

2.11 If you elect to choose a custom discount code, Raw Elements, in its sole discretion, reserves the right to reject your
requested code and modify it or replace it with a generated one.

2.12 Raw Elements reserves the right, in its sole and absolute discretion, to cancel your application to the program if we determine that your site is unsuitable for our program. Including if it:

2.12.1 Promotes sexually explicit materials 

2.12.2 Promotes violence 

2.12.3 Promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age

2.12.4 Promotes illegal activities 

2.12.5 Incorporates any materials which infringe or assist others to infringe on any copyright, trademark or other
intellectual property rights or to violate the law. 

2.12.6 Includes "Merchant" or variations or misspellings thereof in its domain name 

2.12.7 Is otherwise in any way unlawful, harmful, threatening, defamatory, obscene, harassing, or racially, ethnically
or otherwise objectionable to us in our sole discretion. 

2.12.8 Contains software downloads that potentially enable diversions of commission from other affiliates in our
program. 

2.13 You will only use images provided by Raw Elements in your Refersion dashboard.

2.14 You will not create your own coupons to promote Raw Elements’ products.

2.15 You may not create or design your website or any other website that you operate, explicitly or implied in a manner which
resembles our website nor design your website in a manner which leads customers to believe you are Raw Elements or any other affiliated business.

2.16 Raw Elements reserves the right, at any time, to review your placement and approve the use of Your
Links and require that you change the placement or use to comply with the guidelines provided to you.

2.17 It is entirely your responsibility to follow all applicable intellectual property and other laws that pertain to your site. You must have express permission to use any person's copyrighted material, whether it be a writing, an image, or any other copyrightable work. We will not be responsible (and you will be solely responsible) if you use another person's copyrighted material or other intellectual property in violation of the law or any third-party rights.

2.18 You must comply with all federal, state and local regulations within your jurisdiction. This includes applicable governing
marketing emails (ie CAN-SPAM Act), and all other anti-spam laws. Raw Elements reserves the right to suspend or remove affiliates from our affiliate program at any time, without warning. Upon termination, you agree to discontinue use of all links, logos, banners and promotional materials provided to you by Raw Elements or Refersion. Affiliates terminated due to malicious publishing
tactics will also have commissions revoked and face possible omission from the Refersion network.

3. Commissions and Payments

Affiliates earn a standard commission rate of 5% for all sales. We reserve the right to reverse commissions due to returns, order cancellations and erroneous order duplications. We also reserve the right to defer or refuse commissions for disputed orders or orders we reject and cannot fulfill. Payouts will be processed once the return period of 30 days has passed. If accepted in the program you will receive earned commission totaling $25.00 or more once a month through PayPal, so please sign up for our affiliate program with your PayPal email.
